1. Acceptance of Terms
By creating an account and using our platform (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must not use the Service.
2. Services Provided
Our Service allows users to set up competitor monitoring and generate automated reports using AI and other automated systems.
⚠️ AI/Automation Disclaimer
All reports and outputs are automatically generated by AI and automated services. No human has verified the accuracy or completeness of the reports. We do not guarantee the accuracy, reliability, or suitability of any output, and you use the reports at your own risk. We are not liable for any errors, omissions, or decisions made based on the reports.
3. Accounts & Eligibility
You must provide a valid email address to create an account.
You are responsible for maintaining the confidentiality of your login details and all activity under your account.
4. Plans, Billing & Payments (via Paddle)
Merchant of Record. We use Paddle as our reseller and Merchant of Record. Your purchase is from Paddle, which handles checkout, billing, invoicing, and applicable taxes.
Monthly charges. You will be charged monthly in accordance with the active plan on your account. You can cancel anytime. Usage limits apply per plan/package and are shown in your account or pricing page.
Auto-renewal. Subscriptions renew automatically until cancelled. Cancellation takes effect at the next billing date; there are no refunds for partial/unused subscription periods once a billing period has started.
Refunds & consumer rights. Checkout, refunds, cancellations, chargebacks, and tax handling are governed by Paddle’s Checkout Buyer Terms and Conditions. Refunds are handled at Paddle’s discretion and case-by-case in line with those terms. If you’re a consumer, statutory rights may apply, including the EU/UK right of withdrawal; where you choose immediate access to digital content, you may consent to lose that withdrawal right once delivery begins, as described in Paddle’s terms.
Chargebacks & disputes. If you wish to dispute a charge, you agree to contact Paddle before raising a chargeback.
Invoicing/taxes. Invoices/receipts are issued electronically by Paddle, which also determines and collects applicable taxes.
Paddle’s Checkout Buyer Terms and Conditions apply to every purchase made through Paddle. If there is any conflict between these Terms and Paddle’s buyer terms regarding checkout, billing, refunds, cancellations, taxes, and chargebacks, Paddle’s terms will prevail.
5. Fair Use & Limits
Manual (on-demand) report generation and other usage are subject to reasonable limits for your plan.
Excessive or abusive use (e.g., attempting to bypass limits, automated scraping, or actions that impair system stability) may result in suspension or termination.
6. Intellectual Property
Your content. You retain all rights to content you upload.
Our platform. We retain all rights to the Service, including software, features, and branding.
Generated reports. Reports generated through the Service are licensed to you for your own business or personal use; you may not resell or redistribute them without our prior written consent.
7. Liability & Disclaimers
The Service is provided “as is” without warranties of any kind.
We exclude liability for: (i) inaccuracies or omissions in reports or data; (ii) loss of profits, business, or data; and (iii) indirect or consequential damages.
Our total liability under these Terms shall not exceed the amount you paid to us in the three (3) months prior to the claim.
8. Termination
We may suspend or terminate your account if you breach these Terms or misuse the Service. You may stop using the Service at any time and can cancel your subscription as described above.
9. Privacy
We process personal data in accordance with our Privacy Policy. Paddle processes personal data for checkout as Merchant of Record under its own privacy terms.
10. Changes to the Service and Terms
We may update the Service and these Terms from time to time. If changes materially affect your rights, we will provide notice where required by law. Continued use after changes become effective constitutes acceptance.
